• Not a guarantee: We cannot guarantee specific outcomes in your relationships

3. User Obligations and Acceptable Use

3.1 You Must NOT:

• Send messages without consent: You must have explicit permission from recipients to send them automated messages
• Harass or spam: Use our service to send unwanted, threatening, abusive, or harassing messages
• Violate laws: Use the service in any way that violates federal, state, or local laws
• Misrepresent yourself: Impersonate others or provide false information
• Send illegal content: Transmit messages containing illegal, harmful, threatening, defamatory, or obscene content
• Interfere with service: Attempt to hack, disrupt, or damage our systems
• Share account access: Allow others to use your account credentials
• Resell the service: Redistribute or resell access to LoveTextForHer

3.2 Recipient Consent

You are solely responsible for ensuring you have consent from all recipients to send them automated messages. This includes:

• Obtaining explicit permission before adding someone as a recipient
• Respecting requests to stop receiving messages
• Complying with all applicable anti-spam laws (CAN-SPAM Act, TCPA, etc.)
• Understanding that recipients may report unwanted messages as spam

4. Account Registration and Security

4.1 Account Creation

• You must provide accurate, current, and complete information during registration
• You must maintain and update your account information
• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

4.2 Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Abuse of the service or recipients
• Any reason we deem necessary to protect our service or users

5. Subscription and Payment Terms

5.1 Subscription Plans

We offer the following subscription tiers:

• Free Trial: 3 days of full access, no credit card required
• Basic: $2.99/month for up to 3 recipients
• Plus: $6.99/month for up to 8 recipients

5.2 Billing and Payments

• Subscriptions are billed monthly in advance
• All fees are in U.S. Dollars (USD)
• You authorize us to charge your payment method on file
• Failed payments may result in service suspension
• We are not responsible for any bank fees, overdraft charges, or other charges resulting from subscription payments

5.3 Free Trial

• New users receive a 3-day free trial with full access
• After the trial ends, you must subscribe to continue using the service
• Free trials are limited to one per user

5.4 Refund Policy

All sales are final. We do not offer refunds for subscription fees except:

• If required by law
• In cases of service failure or technical issues on our end (at our sole discretion)
• If you cancel within 24 hours of your initial subscription (first-time subscribers only)

5.5 Cancellation

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• You will retain access until the end of the paid period
• No partial refunds for unused time

6. Message Delivery and Service Availability

• Messages will be delivered at the exact scheduled time
• Messages will be delivered at all (due to carrier issues, recipient blocking, etc.)
• Uninterrupted or error-free service
• Service will be available 24/7 without maintenance or downtime

6.2 Service Limitations

• Message delivery depends on third-party SMS providers and cellular carriers
• Recipients may block or filter automated messages
• Carriers may delay or fail to deliver messages
• Message delivery may be affected by recipient's phone status, network issues, or carrier policies

6.3 Maintenance and Downtime

We reserve the right to:

• Perform scheduled maintenance with advance notice
• Conduct emergency maintenance without notice
• Temporarily suspend service for upgrades or repairs

7. Intellectual Property Rights

7.1 Our Intellectual Property

All content, features, and functionality of LoveTextForHer, including but not limited to:

• Software, code, and algorithms
• Text, graphics, logos, and design elements
• Message templates and content generation
• Trademarks and branding

are owned by LoveTextForHer and are protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

• You retain ownership of any content you create or provide
• By using our service, you grant us a license to store, process, and transmit your content as necessary to provide the service
• You represent that you have all necessary rights to the content you provide

Our total liability to you for any claims arising from use of the service is limited to the amount you paid us in the 12 months prior to the claim, or $100, whichever is greater.

We use third-party services for:

• SMS message delivery (e.g., Twilio, AWS SNS, or similar)
• Payment processing
• Analytics and service improvement

We are not responsible for the actions, policies, or failures of these third-party services.

10. Indemnification

You agree to indemnify, defend, and hold harmless LoveTextForHer, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the service
• Violation of these Terms
• Violation of any rights of third parties, including recipients
• Sending messages without proper consent
• Any content you provide or transmit
• Your breach of any laws or regulations

11. Dispute Resolution and Arbitration

11.1 Informal Resolution

Before filing a claim, you agree to contact us at support@lovetextforher.com to attempt to resolve the dispute informally.

11.2 Binding Arbitration

If informal resolution fails, any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules, except:

• Small claims court actions (under $10,000)
• Injunctive relief for intellectual property infringement

11.3 Class Action Waiver
